XCUSTOMERSUPPORT'S
ACCEPTABLE USE POLICY REGARDING BULK E-MAILINGS
If you have recieved a spam email related to one of our sites, we
would like to know about it. Although we do allow affiliates to
promote some of our sites and related products through the transmission
of bulk e-mail, any such mass e-mailings must conform to our bulk
email policies.
(a) The marketing of our Websites is strictly prohibited if done
through the transmission of unsolicited bulk email (UBE). In other
words, the bulk emailing must be pursuant to a prior business relationship
with the e-mail recipient, including but not limited to having obtained
their e-mail address through a verifiable opt-in procedure.
(b) We strictly prohibit marketing of our websites by the transmission
of e-mail that makes use of or contains invalid or forged headers,
invalid or nonexistent domain names or other means of deceptive
addressing (counterfeit e-mail).
(c) We also strictly prohibit marketing of our websites by the transmission
of e-mail that is relayed from any third party's mail servers without
the permission of that third party, or which employs similar techniques
to hide or obscure the source of the e-mail. The transmission of
unsolicited bulk e-mail, including the transmission of counterfeit
e-mail, may result in civil and criminal penalties against the sender
under applicable federal and/or state law.
(d) Our affiliates may not harvest or collect screen names from
any Internet service provider (ISP) for the purpose of sending unsolicited
e-mail. Many ISPs, such as America On Line, Inc. (AOL), have policies
and procedures relating to mass mailings to their members. We suggest
you familiarize yourself with such policies and abide by them. AOLs
policy can be found at www.aol.com/info/bulkemail.html. We will
terminate without pay any affiliate found to have transmitted bulk
emails advertising any websites marketed through this Program to
lists gathered by such methods.
Should we determine that any affiliate has violated this Acceptable
Use Policy, they will be terminated immediately, and will not be
paid for any traffic or subscriptions generated prior to the date
of termination.
FREQUENTLY ASKED QUESTIONS REGARDING SPAM:
1. Is there anything that I can do to prevent spam?
If you have an email address, chances are that you get a huge amount
of Spam per day. By some reports, spam accounts for 50% of the mail
traffic on the Internet! There are several things you can do to
eliminate or at least cut down on the amount of Spam you receive.
You can either add your email to a remove list, install a spam filter
for your mail or contact your dialup and ask their technical staff
to help you. Also try to stay out of chatrooms or messageboards
as some spammers have programs that will scan these boards and retrieve
your email address.
2. I have received several Spam emails from the same person. Should
I forward them all to you?
If all the emails that you have received are the same, Please only
forward just one of the emails. If the emails are all different
in nature, please forward them all to us. Also, please try to include
the user's account number when you contact us. This will help to
terminate the Spammer's account quicker, making the process much
faster.
3. Can you give me the person's information that is spamming me?
No, due to legal liabilities, we can not give out any information
for any of our accounts. We can only provide this information if
we are ordered to do so by a court order.
4. Who do I contact if I am receiving spam emails from one of your
affiliate?
First, make sure the email you received was not something that you
had requested through another source and that it is indeed spam.
If you had not requested the material, please send an email to our
Legal
Department. Please include the spam email in question as
an attachment. Also be sure to include the affiliates linking code,
entire headers in the attachments as well as the entire email, and
any other information that you might have. We take spam very seriously
and will not tolerate affiliates who spam. Affiliates found to have
been spamming will be terminated immediately if proper proof is
provided to us.
5. I have sent you an email regarding a Spammer and have not received
an answer yet. Why?
Please be assured that we take spam very seriously. We fully investigate
each and every single complaint that we receive. The process that
is involved with investigating Spammers is a lengthy process. You
can be certain that your complaint will be given full attention
and if the affiliate is indeed found to be guilty of Spamming, they
will be terminated.
